An assessement of the quality of life in patients with chronic lymphoedema treated by complex decongestive therapy/CDT
Background. Lymphoedema is an accumulation of protein-rich fluid in the interstitial space. Long-lasting
lymphoedema leads to chronic inflammation, fibrosis and tissue damage. Lymphoedema seriously affects a
patient's body image, daily activities and mobility. At present, there is no curative treatment: the aim of
lymphoedema management is long-term symptom control and an improvement in the health-related quality
of life (HRQoL).
Aim. The aim of this study was to assess the following: - the effect of complex decongestive therapy (CDT)
on the quality of life of lymphoedema patients; - the effect of CDT on clinical symptom relief; - changes in
HRQoL domains as defined in the SF-12 questionnaire.
Methods. 30 patients were enrolled into a treatment group in a Lymphoedema Clinic. We assessed physical
symptoms such as pain, heaviness, mobility, the fitting of clothes and body presentation at the beginning of the
study, again after two weeks of intensive treatment and then after 4 months of maintenance therapy. Patients
completed the SF-12 questionnaire at the beginning and at the end of the study.
Results. The research revealed that complex intensive therapy significantly improves both physical and
mental aspects of HRQoL. No correlation between HRQoL improvement and limb volume reduction has been
found. CDT and the intensive phase of treatment in particular improved the fit of clothes and limb presentation,

Organizacja pracy więźniów w Królestwie Polskim w latach 1815-1867
The convicts’ obligation to perform prison labour as an additional form of punishment beyond imprisonment appeared for the first time in the 16th century together with the creation of houses of correction. In the 19th century, statutory law pertaining to labour was regulated in many European penal codes. This concept was also included in the criminal legislation which was in force in the Kingdom of Poland, i.e. in the Penal Code (in forcesince 1818) and in the Code of Major and Correctional Punishments (since 1848). Initially, the work carried out by the prisoners in the Kingdom of Poland was primarily fiscal in nature. The purpose of the labour was for the prisoners to, at least partially, earn a living. However, the penitentiary concepts which began to emerge from the 1930s onwards also started to notice the educational and resocialization value of convict labour. At first, theprisoners were mainly engaged in public works. And later, after 1832, they were put to work in prison workshops and factories. Moreover, they performed services for the benefit of private individuals. The Penal Code obliged the prisoners to work in case of convicts placed in prisons and jails. The Code of Major and Correctional Punishments, which was in force since 1848, maintained the prison labour obligation of the convicts’ sentenced toimprisonment. This additional sanction was connected with the punishment of imprisonment in detention centres and it was also connected with being detained in workhouses or in houses of correction. People sentenced to lighter punishments and those temporarily deprived of liberty were free from penal labour
Niemajątkowe postanowienia w testamentach publicznych sporządzanych przez notariuszy zgierskich w latach 1825–1875
"Zgodnie z treścią art. 895 KN, testament jest to al<t, mocą l<tórego testator
rozporządza na czas, gdy już żyć nie będzie, całością lub częścią swojego majątku,
a który odwołać może. Definicja testamentu zawarta w Kodeksie Napoleona
może wskazywać, iż aktem tym można było dokonać jedynie rozporządzenia
majątkowego. Jednakże ustawodawstwo Królestwa Polskiego i analiza materiału
źródłowego dowodzą, iż XIX-wieczny testament publiczny był aktem, w którym
testator mógł nie tylko rozporządzić swoim majątkiem na wypadek śmierci, ale też

Środek zapobiegawczy w postaci tymczasowego aresztowania znany był już w dawnym prawie polskim. Jednak przez cały okres istnienia I Rzeczypospolitej nie było regulacji dotyczących podstaw stosowania tego środka, uprawnionych podmiotów czy dopuszczalnego czasu pozbawienia wolności bez wyroku sądowego. Podobnie do rzadkości należały odrębne miejsca służące do przetrzymywania osób tymczasowo aresztowanych. Dopiero w drugiej połowie XVIII w. pojawiły się koncepcje zasad wykonywania tymczasowego aresztowania. Ostatecznie czasy Królestwa Polskiego przyniosły praktyczne reformy organizacji więziennictwa, także w zakresie zasad wykonywania aresztu tymczasowego. Niemały wkład w to wnieśli polscy penitencjaryści pozostający pod wpływem europejskich prądów oświeceniowych, a jednym z nich był Fryderyk Skarbek, dzięki któremu w 1835 r. uruchomiono nowoczesne więzienie śledcze w Warszawie zwane Pawiakiem. W artykule przedstawiono zasady funkcjonowania Głównego Więzienia Inkwizycyjnego w oparciu o wydaną 26 listopada/8 grudnia 1835 r. instrukcję oraz uwagi do niej zawarte w odnalezionym w Archiwum Głównym Akt Dawnych w Warszawie dokumencie z 11/23 czerwca 1858 r.Being remanded in custody is a preventive measure which was already known in the Polish law of old. However, during the entire period of the existence of the Polish-Lithuanian Commonwealth, there was no regulation concerning the grounds for applying this measure, authorized entities or the admissible term of detention without a sentence of the court. Similarly, it was exceedingly rare to encounter separate places designated for temporarily holding people in custody. First concepts of principles concerning the execution of provisional detention only appeared in the second half of the 18th century. The final period of the Kingdom of Poland brought about practical reforms in the organization of the prison system also including reforms in the field of execution of pre-trial detention. Polish penitentiary scientists, who were under the influence of the European trends of the Age of Enlightenment, had a quite significant input in this field. One of them was Fryderyk Skarbek and thanks to him a modern detention centre, called Pawiak, which was designed to hold detainees during the investigation, was opened in Warsaw in 1835. The article presents the rules and regulations concerning the functioning of the Main Inquisitorial Prison which were based on the order issued on 26th of November/8 of December 1835 as well as on the comments to it which can be found in a document of the 11th/23rd of June 1858 in “Archiwum Główne Akt Dawnych” [The Central Archives of Historical Records]
Ciąża, poród i opieka nad dzieckiem w więzieniach Królestwa Polskiego (1815–1867)
Genezy współczesnych rozwiązań dotyczących dzieci osób pozbawionych wolności
poszukiwać należy w latach Królestwa Polskiego, gdzie po raz pierwszy dostrzeżono konieczność
uregulowania problemu kobiet ciężarnych i porodu oraz warunków bytowych
matek przebywających wraz dziećmi w zakładach karnych, a także losów nieletnich, pozostających
poza murami w czasie uwięzienia rodziców. Stan polskich więzień w początkach XIX w., nie spełniał nawet ówczesnych standardów. Władze Księstwa podjęły próby reform,
przygotowano projekt ordynacji więziennej: Urządzenie więzień krajowych, jednakże niestabilna
sytuacja kraju, a przy tym brak funduszy, nie pozwoliły na jego realizację. Przełom
w system więziennictwa w Królestwie Polskim przyniosła wizytacja niektórych więzień
stolicy w 1818 r. przez cara Aleksandra I. Niezadowolenie cara spowodowało intensywne
działania centralnych władz rządowych mające na celu reformę warunków wykonywania
kary pozbawienia wolności. Zmiany objęły sytuację matek-więźniarek, a także ich dzieci,
będących pod bezpośrednią opieką rodzica, jak też tych znajdujących się poza więzieniem.
Początkowo, więźniarka w ciąży lub połogu pozbawiona była szczególnej pomocy, ale na
drodze praktyki wykształcił się w latach 30. XIX w. zwyczaj udziału w porodach akuszerek,
ale regulacje ustawowe w tym zakresie pochodzą dopiero z lat 50. tegoż stulecia. Poprawa
fatalnych warunków sanitarnych sprawowania opieki nad noworodkami miała miejsce
w więzieniu warszawskim dopiero w latach 30. XIX w., zaś w kolejnym dziesięcioleciu wydano
pierwsze przepisy administracyjne zapewniające kobietom karmiącym lepsze racje
żywieniowe. Założenie, iż potomstwo nie powinno przebywać ze swoimi rodzicami w zakładach
karnych spowodowało, iż już w roku 1823 r. wydano przepisy administracyjne
regulujące zasady opieki nad dziećmi, które już nie mogły przebywać pod bezpośrednią
opieką matki.Th e origin of contemporary solutions concerning the children of the imprisoned should
be sought in the days of the Kingdom of Poland, when the need to regulate the problem of
pregnant women, delivery, and living conditions of mothers who remained in penal institutions
together with their children, as well as the life of the minors who remained outside
the prison during the imprisonment of the parents were regulated.
Early in the 19th century, the condition of Polish prisons did not meet even the contemporary
standards. Th e authorities of the Duchy attempted to introduce reforms, and
prison law (literally: ‘arrangement of state prisons’) was draft ed, yet the unstable situation
in the country aggravated by the lack of funds did not allow its implementation. A breakthrough in the penal system in the Kingdom of Poland came with the visitation
of some prisons in the capital city by Tsar Alexander I in 1818. Th e monarch’s dissatisfaction
resulted in the intensive activity of central authorities aimed at reforming the
conditions of serving the sentences. Th e changes encompassed the situation of imprisoned
mothers and also their children in direct custody of a parent, and also those living outside
the prison.
Initially, a prisoner in pregnancy and childbirth was deprived of specifi c assistance, yet
the custom of having midwives participating in deliveries developed in the 1830s, even
though legal regulations concerning the question date back to as late as the 1850s.
Th e improvement of the horrible sanitary conditions in newborn care had not taken
place in Warsaw prison until the 1830s, while the fi rst administrative rules ensuring breastfeeding
women with better alimentation were issued a decade later
Utrata mocy testamentu w świetle ustawodawstwa obowiązującego na ziemiach Królestwa Polskiego
"Testament jest czynnością prawną szczególnego rodzaju, gdyż samo jego sporządzenie
nie wywołuje skutków prawnych. Powstanie tych skutków ma miejsce
dopiero w chwili otwarcia spadku, tj. od chwili śmierci testatora. A zatem wyróżnić
można dwa najistotniejsze momenty w funkcjonowaniu tego aktu: moment
sporządzenia i moment jego wejścia w życie. Dla skuteczności aktu prawnego - co
oczywiste - wymagane jest, by podmiot działający, w chwili dokonywania tego
aktu miał odpowiednią, wymaganą przez prawo zdolność. Co do zasady przy czynnościach
prawnych istotny dla oceny ich skuteczności jest moment dokonania.
Jednakże konstrukcja testamentu powoduje, iż analiza skuteczności tej czynności
prawnej możliwa jest nie tylko dla chwili sporządzenia aktu, ale rozważać także
można odpowiednie prawne predyspozycje testatora w chwili otwarcia spadku."(...
Instytucja przymusu osobistego dłużników w sprawach cywilnych na ziemiach Królestwa Polskiego w latach 1815–1875
The Napoleonic Code, which was in force since 1808 first in the Duchy of Warsaw and then in the Kingdom of Poland, provided for the institution of personal coercion in civil matters in Title XVIII (Book III – On Different Modes of Acquiring Property). It was an enforcement measure consisting of sending the debtor to prison in order to force him to fulfil his obligations. Initially, the detention did not result in cancelling the existing debt or did not exclude the possibility of carrying out a further enforcement procedure towards the debtor. Debtors were initially kept in detention centres or taken into police custody. Separate penitentiary bodies were appointed by decision of Administrative Council in 1832. The prison service as well as provisions of the Civil Procedure Code including detailed procedures for the use of coercive measures against debtors, have been defined both in the decision of the Administrative Council of 13/25 September 1832 and in subsequent administrative regulations issued by the Government Commission of Internal and Spiritual Affairs in 1848 and 1859. The 1848 regulations referred to civil jail located in Warsaw at Leszno, but there were no specific instructions for jails in remote regions, which resulted in numerous abuses. It was not until 1859 that the Leszno regulations covered the whole area of the Kingdom of Poland. Coercive measures against debtors could be an effective means of enforcement, although the obligation to provide funding necessary to ensure the livelihood of the debtor constitutes some limitation in applying such a measure. Such a situation meant that at first the debtor tried to enforce the debt using other means. A drawback of the abovementioned institution were problems with the internal organization of the civil detention, particularly in terms of real detention of these debtors, who – according to the source material – were often at large.Kodeks Napoleona, obowiązujący od 1808 r. w Księstwie Warszawskim, a następnie w Królestwie Polskim, przewidywał w Księdze III (o różnego rodzaju sposobach nabycia własności) w tytule XVIII instytucję „przymusu osobistego w materyi cywilnej”. Był to środek egzekucyjny polegający na osadzeniu dłużnika w areszcie w celu zmuszenia go do wykonania ciążącego na nim zobowiązania, przy czym początkowo pozbawienie wolności nie powodowało umorzenia istniejącego długu ani nie wyłączało możliwości prowadzenia dalszej egzekucji z majątku dłużnika. Najpierw dłużników przetrzymywano w aresztach publicznych i aresztach policyjnych. Dopiero decyzją Rady Administracyjnej z 1832 r. utworzono odrębne organy penitencjarne. Organizacja aresztów cywilnych i przepisy kodeksu postępowania cywilnego, rozwijające szczegółowe procedury stosowania przymusu osobistego wobec dłużników, zostały określone w postanowieniu Rady Administracyjnej z dnia 13/25 września 1832 r. i w późniejszych przepisach administracyjnych wydawanych przez Komisję Rządową Spraw Wewnętrznych i Duchownych w 1848 i 1859 r. Regulacje z 1848 r. odnosiły się do aresztu cywilnego znajdującego się w Warszawie na Lesznie, natomiast nie było szczegółowej instrukcji dla aresztów mieszczących się na prowincji, co rodziło wątpliwości co do zasad ich organizacji i dawało możliwość licznych nadużyć. Ostatecznie dopiero instrukcja więzienna z 1859 r. rozszerzała obowiązywanie przepisów dla Leszna z 1848 r. na całe Królestwo Polskie. Instytucja przymusu osobistego dłużników w okresie obowiązywania francuskiej procedury cywilnej mogła być skutecznym środkiem egzekucyjnym, choć pewnym ograniczeniem w jego stosowaniu był obowiązek złożenia przez wierzyciela funduszy niezbędnych na utrzymanie dłużnika, co na pewno powodowało, że najpierw próbował on wyegzekwować dług za pomocą innych rodzajów egzekucji. Mankamentem omawianej instytucji były problemy z wewnętrzną organizacją aresztów cywilnych, w szczególności w zakresie rzeczywistego przetrzymywania w nich dłużników, którzy – jak wynika z materiału źródłowego – w praktyce często przebywali na wolności
Praca lekarzy w więzieniach Królestwa Polskiego – na podstawie akt Rządu Gubernialnego Radomskiego
W pierwszej połowie XIX w. na kanwie europejskiego nurtu humanizacji wykonywania
kary pozbawienia wolności pojawiły się koncepcje polskich reformatorów penitencjarnych,
np. J.U. Niemcewicza, K. Potockiego, czy F. Skarbka – ich postulaty w dużej części
dotyczyły konieczności poprawy warunków sanitarnych w więzieniach, a przede wszystkim
stworzenia systemu opieki lekarskiej nad osadzonymi.
W odpowiedzi władze rządowe podjęły pewne realne działania. I tak postanowieniem
Księcia Namiestnika z 17 września 1823 r. została zatwierdzona Instrukcja więzienna wydana
przez Komisję Rządową Spraw Wewnętrznych i Duchownych. Wprowadzała ona nie
tylko obowiązek organizacji w więzieniach lazaretów, ale także utrzymywania na stałym
etacie lekarza. Weszli oni w skład służby więziennej, a tym samym zaliczono ich w poczet
pracowników służby cywilnej Królestwa Polskiego.
Jednakże brak zapewnienia odpowiednich funduszy, jak i mała liczba wykwalifikowanych
medyków spowodowały, iż wprowadzenie w życie przepisów więziennych było
trudne. Przez cały okres istnienia Królestwa Polskiego władze administracyjne borykały
się z problemem zapewnienia odpowiedniej obsady lekarskiej w lazaretach więziennych.In the first half of the 19th century, the concepts of Polish penitentiary reformers (e.g.
J.U. Niemcewicz, K. Potocki, or F. Skarbek) appeared. These demands largely related to the need to improve sanitary conditions in prisons, and above all to create a medical care system
for inmates. In response, the government authorities took some real steps. And so, by
the decision of the Prince Governor of September 17, 1823, the prison instruction issued
by the Government Commission for Internal and Clergy was approved. It introduced not
only the obligation to organize lazaret prisons, but also to keep a doctor on a permanent
basis. Th ey were included in the prison service, and thus included among the civil servants
of the Kingdom of Poland.
However, the lack of adequate funding and the small number of qualified medics made
implementation of prison regulations difficult. Throughout the entire period of the existence
of the Kingdom of Poland, the administrative authorities struggled with the problem
of ensuring adequate medical staff in prison hospitals

Areszty policyjne zostały utworzone na mocy rozporządzenia Komisji Rządowej Spraw
Wewnętrznych i Policji z dnia 6 października 1817 r. Powołano je do życia w celu zapewnienia
odpowiedniego miejsca odizolowania dla osób aresztowanych przez władze policyjne
w trakcie pierwszych czynności śledztwa. Jednakże w następnych latach areszty policyjne
zyskały kolejne funkcje – jako więzienia dla osób skazanych na krótkoterminowe
kary pozbawienia wolności czy jako miejsca noclegowe dla transportowanych więźniów.
Celem opracowania jest przedstawienie podstaw prawnych osadzenia w areszcie policyjnym
obowiązujących do roku 1867, czyli do czasu likwidacji Komisji Rządowej Spraw
Wewnętrznych. Analizie poddano przepisy administracyjne wydawane przez centralne
organy administracji rządowej oraz dokumenty zgromadzone w archiwach państwowych,
Niestety zachowany materiał archiwalny jest bardzo fragmentaryczny i nie pozwala na precyzyjne
ustalenie miejsc, w których zorganizowane zostały areszty policyjne, ani sporządzenie
szczegółowych statystyk dotyczących osób przetrzymywanych w tych ośrodkach.
Z pewnością jednak możemy stwierdzić, iż areszty policyjne w całym badanym okresie
pozostawały głównie miejscami przetrzymywania osób aresztowanych policyjnie oraz że
nagminnie łamano przepisy o czasie zatrzymania w areszcie.Police detention centres were created by the Government Commission of Internal and
Police Aff airs of October 6, 1817. Th ey were brought to life to provide a suitable place of
isolation for people arrested by the police authorities during the fi rst steps of the investigation.
However, in the following years they gained further functions as prisons for persons
sentenced to short-term imprisonment or as accommodation for transported prisoners.
Th e aim of this study is to present the legal basis for detention in police custody until
the Government Commission for Internal Aff airs is liquidated (1867) on the basis of
administrative regulations issued by central government administration bodies and documents
collected in state archives. Unfortunately, the preserved archival material is very
fragmentary, it does not allow precise determination of places where police arrests have
been organized, or detailed statistics on persons held in these centers. Certainly, however,
we can conclude that the police detention centres in the entire period considered were
mainly places of detention for police arrested persons, and that the regulations on the time
of detention were repeatedly violated
